Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the GrowthNerds website, platform, and related services (collectively, the “Services”) provided by GrowthNerds, LLC (“GrowthNerds,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

GrowthNerds provides software tools that help independent agencies and their teams manage recruiting workflows, candidate communication, scheduling, and related operations. Features may change over time. We may add, modify, or discontinue parts of the Services at any time.

Access to certain parts of the Services requires an account. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.

Some users receive access by invitation or approval during limited release periods. We may suspend or revoke access if we reasonably believe these Terms have been violated or if continued access would create risk to the Services or other users.

You agree not to:

• Use the Services in violation of applicable law or third-party rights.
• Send unlawful, deceptive, abusive, or unsolicited communications through the platform.
• Attempt to gain unauthorized access to systems, accounts, or data.
• Interfere with or disrupt the integrity or performance of the Services.
• Reverse engineer or attempt to extract source code except where permitted by law.

Agency customers are responsible for the content of messages they send and for obtaining any consent required before contacting applicants or candidates.

If you receive recruiting-related text messages through GrowthNerds, those messages are sent on behalf of the agency or organization you applied to or engaged with. Message and data rates may apply. Reply STOP to opt out and HELP for help.

Customers using SMS features must comply with applicable messaging laws and carrier requirements, including providing accurate opt-in disclosures and honoring opt-out requests.

The Services may integrate with third-party tools such as email providers, SMS carriers, calendar systems, or authentication providers. Your use of those services may be subject to separate terms and privacy policies. GrowthNerds is not responsible for third-party services we do not control.

GrowthNerds and its licensors own the Services, including software, branding, and content we provide. These Terms do not grant you any ownership rights in the Services except the limited right to use them as permitted here.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, GROWTHNERDS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

GrowthNerds does not provide insurance, legal, tax, or employment advice. Agency customers remain responsible for their own recruiting, licensing, and compliance obligations.

TO THE FULLEST EXTENT PERMITTED BY LAW, GROWTHNERDS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination will survive, including disclaimers and limitations of liability.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and revise the “Last updated” date above. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
